BKN obtains a pair of appellate victories for its clients

BKN attorneys Robert Baker and Derrick Lowe successfully pursued a pair of appeals on behalf of two separate clients to wrap up Spring of this year.

The first, argued before the Ninth Circuit in May, resulted in the reversal of a summary judgment in an insurance bad faith matter. The District Court improperly granted summary judgment against our client, a Southern California school district, a decision that the Ninth Circuit rectified by holding that the defendant insurance company had in-fact breached its duty to defend to our client. As a result, our client was able to recover over $1.4 million in defense costs.

And the second, argued before the California Court of Appeal in San Francisco at the beginning of June, followed the full dismissal of a legal malpractice claim against our client on a demurrer. The Court of Appeal, in a carefully drafted opinion, examined each of the many grounds that the trial court relied on to sustain the demurrer and ultimately upheld the trial court’s decision in full, finally ending this long-running malpractice claim against our client.
